 Legislation Documents

There are a number of pieces of legislation that relate to disaster preparation, mitigation and recovery.  The following are some key pieces and the main provisions of each.

Building Act 1988

Section 22 (1) Special Emergency Powers

If the Minister at any time that any building owing to the occurrence of flood, fire, hurricane or any other disaster (whether caused by God or man), is in such condition as to be dangerous to persons or property in its vicinity, and is beyond repair, and that danger cannot be effectively obviated by the exercise by him or any of the powers conferred upon him by section 20 or 21, he may, subject to subsection (2), cause the building or part of the building to be demolished.

(2) Before any building or part of a building is demolished under subsection (1), all articles or things within the building or its cartilage which, in the opinion of the person charged by the Minister with the demolition, appear to be of value and to be capable of being removed without endangering the safety of any person, shall be removed by that person and stored by the Minister until claimed by the owner or until the expiration of the period of twelve months, whichever first occurs.

Emergency Powers Act 1963

Section 3 (1) Regulations by the Governor

The Governor may make such regulations as appear to him to be necessary or expedient for securing public safety, the welfare and defence of Bermuda, the maintenance of public order and the suppression of mutiny, rebellion and riot, and for maintaining supplies and services essential to the life of the community.

Defence Act 1965

Section 32 (1) Embodiment of the Regiment

The Governor, if it appears to him to be necessary to do so in the interest of public safety or the defence of Bermuda, may by order published in the gazette, or otherwise made known to members of the regiment in such a manner as may seem to him best suited to the circumstances, direct that the regiment or any part of the regiment be embodied; and upon the making of such an order every member of the regiment affected by the order shall report at such place and at such time as may be specified in the order or made known to him by or through any of his officers or otherwise duly made known to him.
